Terms and Conditions

General Terms and Conditions (GTC)

1. Scope

These terms and conditions apply to all orders placed via the Myko Manufaktur online shop at myko-manufaktur.de .

2. Contracting parties

The purchase agreement is concluded with:

3. Offer and conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By clicking the "Buy Now" button, the customer submits a binding purchase offer. The contract is concluded as soon as the order is confirmed by email.

4. Prices and shipping costs

All prices are final prices in euros, including VAT where applicable. Shipping costs are additional and will be shown separately during the order process.

5th delivery

Delivery will be made to the delivery address specified by the customer. Delivery times are non-binding unless a specific date has been agreed upon.

6. Right of withdrawal

Consumers generally have a right of withdrawal.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts for the delivery of:

  • food or perishable goods,
  • Goods that are not suitable for return for reasons of health protection or hygiene,
  • Mushroom growing kits and mycelium products, as these are living organisms.

Therefore, a cancellation is excluded once the goods have been shipped.

7. Mushroom Growing Kits and Disclaimer

Mushroom growing kits contain live cultures and require adherence to the supplied care and usage instructions.

The success of mushroom cultivation depends significantly on external factors, in particular:

  • Temperature, humidity and light conditions,
  • Hygiene and proper handling,
  • Follow the instructions.

Myko Manufaktur does not guarantee breeding success if the instructions are not followed or unsuitable conditions exist.

There is no entitlement to a refund or replacement if a mushroom growing kit fails to produce a yield due to improper use, incorrect storage, or external influences.

8. Warranty

The statutory warranty rights apply.

For perishable goods or live crops, the warranty is limited to defects that were already present at the time of delivery.

9. Liability

Myko Manufaktur is liable without limitation in cases of intent and gross negligence.

In cases of simple negligence, Myko Manufaktur is only liable for breaches of essential contractual obligations (cardinal obligations) and limited to foreseeable damages.

10. Retention of title

The goods remain the property of Myko Manufaktur until full payment has been received.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

The law of the Federal Republic of Germany applies.

Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
